The House of Commons has voted this afternoon to reject the Lords Amendment (promoted by Viscount Hailsham and Dominic Grieve) to the European Union (Withdrawal) Bill which would have required the Government to allow MPs to vote on an amendable motion as to how it should proceed in the absence of a Brexit deal by 21st January next year (rather than a ‘neutral’, non-amendable motion, as in the Government’s version proposed). It was defeated by 319 votes to 303. Grieve himself said during the course of the debate that he would after all support the Government after David Davis, the Brexit Secretary, issued a statement which Grieve said amounted to an “obvious acknowledgement of the sovereignty of this place over the executive in black and white language”. The statement from Davis said: “Under the Standing Orders of the House of Commons it will be for the Speaker to determine whether a motion when it is introduced by the Government under the European Union (Withdrawal) Bill is or is not in fact cast in neutral terms and hence whether the motion is or is not amendable”. Standing Order 24B of the House of Commons clearly states: “Where , in the opinion of the Speaker or the Chair, a motion, That this House, or, as the case may be, the committee has considered the matter, is expressed in neutral terms, no amendments to it may be tabled”. But Grieve nonetheless moved his amendment so that the Commons would be able to vote on it. 303 MPs voted for the Amendment (305 if you include the two tellers), including 6 Conservatives, 244 Labour MPs, 35 SNP MPs, 11 Lib Dem MPs, along with MPs from Plaid Cymru, the Green Party and 4 Independents. Meanwhile, 319 MPs voted against the Amendment 321 including two tellers), including 306 Conservatives, 4 Labour MPs, 10 DUP MPs and 1 Independent. Below are full lists of which MPs voted for the Amendment, those who did not vote at all (although NB it is impossible to know whether they deliberately abstained, were away from Westminster on parliamentary business elsewhere or were ill etc.) and of course the full list of those who voted against the Amendment. The Amendment will now return to the House of Lords which has to decide whether to accept or reject it.
