How each peer voted on the Article 50 Bill amendment on EU citizens’ rights

The Government suffered a defeat on the Article 50 Bill in the House of Lords last night during the Bill’s Committee Stage – on the issue of linking the guaranteeing of the rights of EU citizens to the right to trigger Article 50.

The amendment – passed by 358 votes to 256 – was tabled by the Labour front bench in the Lords with the backing of peers from all sides of the House. It stated that ministers would be compelled to “bring forward proposals to ensure that citizens of another European Union or European Economic Area country and their family members, who are legally resident in the United Kingdom on the day on which this Act is passed, continue to be treated in the same way with regards to their EU derived-rights and, in the case of residency, their potential to acquire such rights in the future.”

The Government has already signalled its intention to reverse this when the Bill returns to the House of Commons, having indicated time and again that it does wish to guarantee the rights of EU nationals in the UK, but that to do so unilaterally would possibly create an unnecessarily longer period of uncertainty for UK nationals in EU countries since any urgency to resolve their status would be removed by the UK making a one-sided guarantee.
